加班僅補休？圓山飯店挨罰

加班只給補休就夠了？小心挨罰！北市勞動局昨（4）日公布違反《勞基法》遭裁罰企業黑名單，包括圓山飯店、家樂福、統一超商等28家業者上榜，其中圓山飯店因連續違規挨罰最多，違反5項法令計處24萬元。

北市勞動局表示，違反延長工作時間未依規定加給工資最多，計有12家；工資未全額直接給付勞工計8家；每7日中未有一日休息作為例假及假日工資未給，或於休假日工作未依規定加給工資分別有7家業者違法。

其中挨罰金額為此次最高的圓山飯店，計違反5項法令，其中加班不給加班費屬連續違規。據平面媒體報導，業者表示，員工加班可額外補休，補休時數為正常上班時數1.5倍，勞工補休時數多於勞基法規定。

但北市勞動局強調，公司員工加班依法應給予加班費，除經員工雙方同意後，才可換為補休；然圓山飯店卻僅提供加班員工補休時數，明顯有違現行規定。
