亡夫手機爆偷腥　小三口交不起訴

【綜合報導】台北市1名林姓婦人去年12月底喪夫，拿丈夫先前手機欲重溫往昔甜蜜，卻赫見亡夫偷腥照，與1名陳姓女同事(約60歲)涉多次口交，林婦氣得告陳女。但台北地檢署認定，通姦罪須性器接合才成立，2婦最後和解且撤告，不起訴陳女。

陳女出庭時，坦承去年多次與死者在飯店約會，指稱當時僅為對方口交、未嘿咻，後悔與死者暗通款曲，對林婦「感到抱歉」；檢察官審酌，2人無嘿咻的直接證據，口交也非《刑法》通姦罪的構成要件，加上林婦已與陳女和解撤告，因此將陳女不起訴。
